Contract terms of Matrix AI Academy & Business Solutions GmbH for courses, consulting and related services.

Terms

1.Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between Matrix AI Academy & Business Solutions GmbH, Neue Grünstraße 10/11, 10179 Berlin, and users of the services offered, in particular the booking of and participation in courses and training. By booking a course, the customer accepts these GTC in the version valid at the time of booking.

2.Contracting partner

The contracting partner is Matrix AI Academy & Business Solutions GmbH, Neue Grünstraße 10/11, 10179 Berlin, Germany. The services are aimed at consumers, companies, educational institutions and funding bodies.

For the delivery of funded training programmes, TSA Weiterbildung & Bildungsakademie GmbH may be involved as an education partner. TSA Weiterbildung & Bildungsakademie GmbH is not a Matrix office or branch of Matrix AI Academy & Business Solutions GmbH.

3.Subject matter of the contract

Matrix AI Academy offers online courses and in-person training in artificial intelligence (AI), machine learning, digital marketing and related fields. The precise course content and formats, whether online or on site, are set out in the course descriptions on the website. Booking a course entitles the participant to use the services specified in the course description.

4.Conclusion of contract

  1. The presentation of courses on the website constitutes a non-binding offer. By booking a course, the customer submits a binding offer. The contract is concluded when Matrix AI Academy & Business Solutions GmbH confirms the booking by email.
  2. The customer is obliged to provide all information required for the booking (e.g. name, address, payment information) correctly.
  3. Participation in the courses is subject to full receipt of payment, unless funding via an education voucher or the Qualification Opportunities Act (QCG) is used.

5.Services of Matrix AI Academy

  1. Matrix AI Academy offers a broad range of training in artificial intelligence (AI) and digital applications. This includes both online and in-person courses delivered in cities such as Berlin, Hamburg, Frankfurt and others.
  2. Courses are offered in several languages (German, English, Turkish) in order to reach a broad audience. The precise course content is described in detail in the course descriptions.
  3. Matrix AI Academy reserves the right to change course content, dates or instructors where this is necessary for the quality and delivery of the courses and the learning objective is not impaired.

6.Payment terms

  1. Course fees are payable immediately after booking. Matrix AI Academy offers various payment methods:
    • Bank transfer
    • PayPal
    • Bankful
    • Stripe
    • Cash (only for certain courses and by prior arrangement on site)
  2. In addition to the standard payment methods, courses may also be financed through public funding programmes, such as the education-voucher programme of the Employment Agency or the Qualification Opportunities Act (QCG).
  3. Self-payers who do not receive an education voucher or QCG funding are obliged to pay the course fee in full before the course begins. Access to online courses is activated only after receipt of payment.
  4. For payments via external payment service providers (e.g. PayPal, Bankful, Stripe), their terms and privacy policies also apply.

7.Right of withdrawal

  1. Consumers have a 14-day right of withdrawal under statutory provisions. The period begins upon conclusion of the contract (e.g. the confirmation email).
  2. To exercise the right of withdrawal, the customer must send an unambiguous declaration by email or in writing to Matrix AI Academy & Business Solutions GmbH.
  3. In the event of withdrawal, course fees already paid will be refunded within 14 days of receipt of the withdrawal declaration.

8.Cancellation and rebooking

  1. Cancellations after expiry of the withdrawal period are possible only under special circumstances (e.g. illness or similarly serious reasons) and upon presentation of a medical certificate. In this case the customer may request a rebooking or a partial refund of the course fees.
  2. Rebookings to other dates are possible, subject to availability, in consultation with Matrix AI Academy and against a processing fee.

9.Funding via education vouchers and QCG

  1. Matrix AI Academy courses are in many cases eligible for funding via education vouchers from the Employment Agency or the Qualification Opportunities Act (QCG). Customers who wish to apply for funding should first contact their responsible Employment Agency and submit the relevant applications.
  2. If funding via an education voucher or QCG is not approved in time, the customer may, after consultation with Matrix AI Academy, pay the participation fee in advance as a self-payer and later request reimbursement from the funding body.
  3. Self-payers who cannot use funding may pay the course fee in one sum or in previously agreed instalments. Participation in the course is, however, possible only after full receipt of payment.

10.Rights of use

  1. By participating in the courses, the customer receives a simple right of use in the training materials provided. This right of use is limited to personal use.
  2. Any reproduction, distribution or commercial use of the course materials without the prior written consent of Matrix AI Academy & Business Solutions GmbH is prohibited.

11.Liability

  1. Matrix AI Academy & Business Solutions GmbH is fully liable for intentional and grossly negligent damage.
  2. For simple negligence, Matrix AI Academy & Business Solutions GmbH is liable only in the event of a breach of material contractual obligations, and liability is limited to the foreseeable damage.
  3. Matrix AI Academy & Business Solutions GmbH accepts no liability for technical disruptions or outages that lie outside its sphere of influence (e.g. those caused by external providers).

12.Data protection

Personal data are processed in accordance with statutory data-protection provisions. Further information can be found in our Privacy Policy.

13.Final provisions

  1. Amendments and additions to these GTC must be made in writing.
  2. Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
  3. The law of the Federal Republic of Germany applies. The place of jurisdiction for disputes arising from these GTC is Berlin.
